Terms of Service

1. What DealProof is and is not

DealProof is a pre-payment verification workflow for private transactions between buyers and sellers. It lets a buyer request that a seller record live, prompted video evidence of an item before the buyer decides whether to proceed with a purchase.

DealProof is not a payment platform, escrow service, marketplace, broker, auction house, or dispute-resolution service. DealProof does not process, hold, transmit, or escrow payment between buyers and sellers, does not list items for sale, does not take custody of any item, and does not participate in the underlying transaction in any way. Any payment between buyer and seller happens entirely outside DealProof, by whatever method the parties choose, at their own risk.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use DealProof. By using the service you represent that this is true.

3. Accounts and access links

Buyers may create DealProofs as guests (email only) or with a full account. Sellers participate through secure, single-deal access links. You are responsible for safeguarding your password and any access or tracking links sent to you; anyone holding a valid link can act on it. We may suspend or terminate accounts that violate these terms.

4. No guarantees

DealProof provides tools that may reduce the risk of fraud. It does not and cannot eliminate it. DealProof does not guarantee that any seller is honest; that any item is authentic, legal, safe, functional, or as described; that any identity-verification result establishes trustworthiness; or that any transaction will be completed or completed safely. A completed verification, an accepted proof, or an “identity verified” status is information for your own decision. It is not a recommendation, endorsement, or guarantee by DealProof.

5. Fees

Standard DealProofs are currently free. Verified DealProofs carry a one-time verification fee, charged to the buyer. The fee is authorized when the DealProof is created and captured only when the seller passes the ID check and submits proof; if the seller does not complete both before the DealProof expires, is cancelled, or is closed out, the authorization is released and the buyer is not charged. Once the seller has passed the ID check and submitted proof, the verification service has been delivered and the fee is earned regardless of the buyer's decision; fees are not refunded because a buyer rejects a proof. This is a verification fee, not a transaction fee, commission, or payment for the underlying item.

6. Acceptable use

You agree not to use DealProof to:

  • verify, promote, or further any transaction that is illegal where you are located;
  • facilitate the sale, purchase, shipment, or transfer of firearms, ammunition, or other regulated items. DealProof does not facilitate such transactions and does not advise on payment, shipping, or transfer procedures for any item; where users employ verification in connection with lawful private transactions, compliance with all applicable laws is solely their responsibility;
  • record, upload, or transmit content that is unlawful, abusive, or infringes the rights of others;
  • impersonate another person, misrepresent an item, or stage deceptive proof;
  • probe, disrupt, or abuse the service, other users, or our infrastructure.

DealProof may restrict item categories, refuse service, disable DealProofs, or suspend users at its sole discretion, including where we suspect fraud or unlawful activity.

7. Your content

Proof videos and other content you submit remain yours. You grant DealProof a limited license to store, process, and display that content as needed to provide the service. Most importantly, sharing a seller's proof video and submitted details with the requesting buyer. Proof videos are retained for a limited period (currently 30 days for Standard and 90 days for Verified DealProofs) and then deleted; deal records and audit logs are retained. We may remove content or act on reports at our discretion. To report content, use the “Report this proof” control or email abuse@trustdealproof.com.

8. Third-party services

Payments and identity verification are processed by Stripe under their own terms. DealProof never receives card numbers, and identity documents are processed by Stripe. Buyers see a status only, never documents.

9. Disclaimer of warranties

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Your use of the service and any decision to transact with another user is at your sole risk.

10. Limitation of liability

To the maximum extent permitted by law, DealProof and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from a transaction between users, including fraud by a counterparty, and our total liability for any claim will not exceed the greater of $100 or the verification fees you paid to DealProof in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold DealProof and its operator harmless from claims arising out of your use of the service, your content, your transactions with other users, or your violation of these terms or applicable law.

12. Changes and termination

We may update these terms; material changes will be reflected by the date above and continued use constitutes acceptance. We may modify or discontinue the service at any time.

13. Governing law and contact

These terms are governed by applicable United States federal and state law. Questions: notifications@trustdealproof.com · Abuse reports: abuse@trustdealproof.com.
